I am 56 years of age; my post office address is Burt, Mich R.D. #3. I am a gruss widow as I here lift my husband Henry Leeman and I am living with my sister. Have no occupation. I claim to be the legal widow of George W. Lawhead who served in Co B 2nd Mich Cav war of the rebellion.

I was born and reared in Deerfield in state don't know county, think it's Osceola. My parents moved from there when I was very small into Albee Twp near here. I lived here until about 20 years ago and then I moved to Frederick, Crawford Co Mich and lived there until last March when I came here and have lived with my sister ever since.

I have been married three times. 1st to Wm Jones to whom I was married in Genesee Co Mich August 16 sometime after the war. Jones died in Spurdury County near Foster. He died in Aug (crossed out) don't remember the year. I don't know where he is buried. I was not living with him at time of his death. I never was divorced from him. My second husband was George W. Lawhead. I was married to him at Grayling Crawford Co Mich. I could not give the year, it was on March 24. I lived with him until he died at East Jordan, Mich where he is buried. Henry Leeman is my 3rd husband who lives in Frederick Mich. I was married to him July 24, 1904 at Mt. Pleasant Isabella Co. Mich.

I first knew the soldier Lawhead right here in this neighborhood. We lived together about 13 years. Soldier left two children by me who were under 16 years of age at time of his death.

Ethel Mildred Lawhead is the oldest. She was born in Foster in Ogemaw Co. Mich and she will be 20 years old Oct. 24, 1912 and that would make her born Oct 24, 1892.

Jessie Leuella Lawhead is the youngest and she was born May 22 and was 16 years old last May and that would make her born May 22, 1896.

Yes, he soldier had other children but not by me had them by Emma Stiles, his first wife and had two girls.

Margaret was the oldest and Effie was the youngest. They were grown women married and had children when soldier died. Both had middle names and I think Effie's was May and I think Margarets was Amelia.

Soldier had been married 3 times. His first wife was Emma Stiles who died in Albee Twp this County buried in Albee Cemetery, there is no tombstone at her grave. His second wife was one Helen somebody to whom he was married in Taymouth Genesee Co Mich. He left her, don't think he got any divorce. She is dead so I heard not know when and where. I don't know any of her relatives or where she came from.

It was since my marriage to the soldier that I heard his 2nd wife was dead. Some one told me of her death, don't remember now who it was.

Ethel was born near Foster Ogemaw Co Mich. A Mrs. Transos who was a neighbor of mine was with me at the time. I don't know where she is.

A doctor was with me when Jessie was born. He did live at Roscommon Mich, can't remember his name but he is dead.

I have no record of the dates of their birth, did <unreadable> to put it in the bible. No I never knew soldier by any name than Lawhead, never knew him by name of Loyd.

Well I have heard said soldier had another wife living in Lansing Mich. I told him what I had heard but he denied it. Never had another wife before Emma Stiles, said he never had any other children. I saw him a few times, once or twice when he lived with Emma Stiles. No, I know nothing as to his whereabouts before his marriage to Emma Stiles nor does any here abouts.

My maiden name was Larags. Either I or soldier read a letter from this Lansing Woman asking him for a part of his pension. He said that she was not his wife.

Hernon was our post office in Ogemaw Co Mich. No, my first husband William Jones was not dead when I married soldier, nor was we ever divorced. I left him <unreadable> and just run onto Lawhead and married him. Guess I was crazy for doing such a thing. I heard that Jones was dead while Lawhead was living. I realize that I am not intitled to a pension of widow of soldier. I want it for the children of soldier that's all.

Marriage record #6 of Crawford County Michigan states that George Lawhead, age 60, living in Frederick Mich, born in Ohio to parents James Lawhead and Tempy Gilson married Henrietta Jones, age 50, living in Frederick Mich and born in Mich were married March 23, 1903. The marriage record does not give Henrietta's parents. It does state that both George and Henrietta were previously married once each. Robert McElroy, Justice of the Peace married them, Frank Griffin and Mary Wheeler were witnesses.

Herewith are returned the papers in the above entitled claims, which were originally referred to this Division under order 33, paragraph 8, and were sent to the field for special examination under instructions incorporated in letter of July 27, 1911 (Ex. A, Rep. 1).
The soldier and the claimant Mary were ceremonially married in Eaton County, Michigan, October 16, 1865, and lived and cohabited as husband and wife for a year or two when the soldier deserted Mary. He was then married in Saginaw County, said State, January 31, 1869, to one Emma Stiles, who, according to his statement in his family data circulars, died April 8, 1886. It is alleged that he was then married to one Helen, from whom he soon separated and concerning whom nothing further was ascertained, after which, as alleged, he was married in Crawford County, Michigan, to the claimant Henrietta, mother and guardian of the minors claimed for, with whom he appears to have lived until his death, which occurred in Charlevoix County, said State, January 20, 1905. The evidence, record and parol, tends to show that neither he nor Mary ever procured a divorce.
The soldier was not married prior to his marriage to Mary. Mary was previously married in Eaton County, Michigan, January 8, 1854, to one Orrin Doan, from whom she separated a few months later and who survived her marriage to the soldier and died, apparently undivorced, October 22, 1876. It is evident that if Mary's marriage to Doan was a valid marriage, she never became the lawful wife of the soldier, for she and Doan were never divorced and her relations with the soldier terminated long prior to Doan's death.
But it is quite evident that Mary's marriage to Doan was not a valid marriage. Sec. 3204, Compiled Laws of Michigan, 1857, effective at the time said marriage was contracted, provides as follows:
Every male who shall have attained the full age of eighteen years, and every female who shall have attained the full age of sixteen years, shall be capable in law of contracting marriage, if otherwise competent.
And Sec. 3223 provides as follows:
In case of a marriage solemnized when either of the parties was under the age of legal consent, if they shall separate during such non-age, and not cohabit together afterwards, the marriage shall be deemed void without any decree of divorce or other legal process.
Mary alleges the marriage record shows that she was but fifteen years of age at the time she married Doan, January 8, 1854. According to a bible record in her possession, she was born September 8, 1838, which also fixes her age at fifteen at date of marriage. And it is clearly shown that she lived with Doan only until the spring following the marriage, when her parents interfered, the separation occurring prior to the time she reached the age of sixteen years. Moreover, there is a question as to Doan's legal competency. He was thirty years of age and appears to have been previously married and there is nothing to show that his prior wife was dead or divorced at the time of his marriage to Mary.
Mary's legal competency at the time of her marriage to the soldier is deemed in nowise impaired by her prior marriage to Doan, which must be considered a mere nullity. And as it appears that neither she nor the soldier procured a divorce, it follows that all of the soldier's subsequent marriages were null and void, including that to the claimant Henrietta, if any, which alleged marriage in any event must be deemed null and void as Henrietta frankly admits that she had a husband by prior marriage living and undivorced at the time it was contracted.
I am therefore of the opinion that the validity of the claimant Mary's marriage to the soldier should be accepted as established, together with its subsistence up to the time of the soldier's death; that his subsequent marriage, if any, to the claimant Henrietta was null and void; that Mary is in consequence entitled to recognition as his lawful widow; and that Henrietta's title as such, carrying with it the title of the minors claimed for as his legitimate issue, must fail accordingly (See cases of Lorinda M. Kellogg, 7 P. D. , 31 and Francis Fortan, 16 P. D. , 408).

I am a resident of the County of Roscommon, State of Michigan, was a soldier in the service of the United States, in CO. B. Second Michigan Cavalry. I enlisted September 9, 1861 and was honorably discharged the 7th day of August 1865. I contracted sore eyes in the battle of Perryville Kentucky, by being exposed for a long time in the smoke of the artillery, was never treated in an hospital for sore eyes. It was after my discharge from service that the disease became worse. I am also a sufferer from Rheumatism and kidney trouble ever since the year 1871. I am now a farmer by occupation. My eyes are for the past 15 years in such a shape that I am part of the time unable to read and write or to perform manual labor. I am sometimes weeks at a time that I am unable to work on account of Rheumatism and suffer also severely from Kidney trouble.

After my discharge from the service I resided in Eaton County, Michigan until about the 1st of October 1872. Then removed to Tawas, Mich where I resided until Christmas 1880. From Tawas I removed to Meredith Mich and lived at that place until about the 1st of March of 1891. From there I came to West Branch, Ogemaw County, Michigan and moved from that place to Roscommon, Michigan the 15th day of April 1893. I further depose that I have directed Charles D. DeWaile, a circuit court commissioner of Roscommon County to write this affidavit which I have dictated to him in my presence.

I have been married three times. 1st to Wm Jones to whom I was married in Genesee Co Mich August 16 sometime after the war. Jones died in Spurdury County near Foster. He died in Aug (crossed out) don't remember the year. I don't know where he is buried. I was not living with him at time of his death. I never was divorced from him. My second husband was George W. Lawhead. I was married to him at Grayling Crawford Co Mich. I could not give the year, it was on March 24. I lived with him until he died at East Jordan, Mich where he is buried. Henry Leeman is my 3rd husband who lives in Frederick Mich. I was married to him July 24, 1904 at Mt. Pleasant Isabella Co. Mich.

I first knew the soldier Lawhead right here in this neighborhood. We lived together about 13 years. Soldier left two children by me who were under 16 years of age at time of his death.

Ethel Mildred Lawhead is the oldest. She was born in Foster in Ogemaw Co. Mich and she will be 20 years old Oct. 24, 1912 and that would make her born Oct 24, 1892.

Jessie Leuella Lawhead is the youngest and she was born May 22 and was 16 years old last May and that would make her born May 22, 1896.

Yes, he soldier had other children but not by me had them by Emma Stiles, his first wife and had two girls.

Margaret was the oldest and Effie was the youngest. They were grown women married and had children when soldier died. Both had middle names and I think Effie's was May and I think Margarets was Amelia.

Soldier had been married 3 times. His first wife was Emma Stiles who died in Albee Twp this County buried in Albee Cemetery, there is no tombstone at her grave. His second wife was one Helen somebody to whom he was married in Taymouth Genesee Co Mich. He left her, don't think he got any divorce. She is dead so I heard not know when and where. I don't know any of her relatives or where she came from.

It was since my marriage to the soldier that I heard his 2nd wife was dead. Some one told me of her death, don't remember now who it was.

Ethel was born near Foster Ogemaw Co Mich. A Mrs. Transos who was a neighbor of mine was with me at the time. I don't know where she is.

A doctor was with me when Jessie was born. He did live at Roscommon Mich, can't remember his name but he is dead.

I have no record of the dates of their birth, did <unreadable> to put it in the bible. No I never knew soldier by any name than Lawhead, never knew him by name of Loyd.

Well I have heard said soldier had another wife living in Lansing Mich. I told him what I had heard but he denied it. Never had another wife before Emma Stiles, said he never had any other children. I saw him a few times, once or twice when he lived with Emma Stiles. No, I know nothing as to his whereabouts before his marriage to Emma Stiles nor does any here abouts.

My maiden name was Larags. Either I or soldier read a letter from this Lansing Woman asking him for a part of his pension. He said that she was not his wife.

Hernon was our post office in Ogemaw Co Mich. No, my first husband William Jones was not dead when I married soldier, nor was we ever divorced. I left him <unreadable> and just run onto Lawhead and married him. Guess I was crazy for doing such a thing. I heard that Jones was dead while Lawhead was living. I realize that I am not intitled to a pension of widow of soldier. I want it for the children of soldier that's all.

Q. Do you desire to be present in person or by atty or both at my further special examinations of this case that may be held here or elsewhere.
A. No

Marriage record #6 of Crawford County Michigan states that George Lawhead, age 60, living in Frederick Mich, born in Ohio to parents James Lawhead and Tempy Gilson married Henrietta Jones, age 50, living in Frederick Mich and born in Mich were married March 23, 1903. The marriage record does not give Henrietta's parents. It does state that both George and Henrietta were previously married once each. Robert McElroy, Justice of the Peace married them, Frank Griffin and Mary Wheeler were witnesses.
Children were: Ethel Mildred LAWHEAD, Jessie Leuella LAWHEAD.

From time of our childhood she and I were under each others observation up to 20 years ago and <unreadable> died him I have not seen her until last Feby.

I first knew George W. Lawhead etc. soldier for about 10 years before his first wife Emma Stiles died. I knew her when we were children at school together. I know nothing of soldiers whereabouts before his marriage to Emma Stiles. I was at the funeral of Emma, but I can't remember date of her death.

In about one year after Emma's death soldier married one Helen Vorst, who was quite old don't think she had been previously married. They had no children, never were divorced, just parted, she went away and <unreadable> where she went to was where she is. The aid her some relative but they are dead. Soldier next wife was claimant and she claimant had a living and undivorced husband at the time of her marriage. His names was William Jones and she left him and married Lawhead without going through the formality of divorce.

Emma Stiles Lawhead has two children by soldier: Margaret and Effie.
Soldier had two children under 16 years of age by claimant at time of his death. Ethel Mildered and Jessie Lureen. Ethel will be 20 years old next Oct. she is married, can't give date of birth. Jessie is 16 years old last May. I do not know date of their birth. She is unmarried.

I have no interest in this case. I have heard this deposition read, have freely understood questions asked and my answers was correctly <unreadable>.

According to Marriage Record #3367 of Saginaw County, on August 17, 1884, George Lawhead married Ellen A Bird Vorrheis. George was 38 and Ellen was 53 at the time. Francis W. McNalley, Justice of the Peace performed the ceremony, Philip Fitch and Robert J Morris were the witnesses. There is no record of previous marriage recorded for either George or Ellen. It is assumed that this Ellen A Bird Vorrheis is the Helen Vorst mentioned in George Lawhead's Civil War Pension File.

A mystery: In the 1890 Veterans Schedule for Albee Township, Saginaw County, Michigan there is a listing for Stephen Jones and immediately afterwards is Ellen A. Lawhead Widdowed appearing to be living with James Bird. Both listings appear to be living in Verne, Saginaw County (the corner of Sheridan and Verne Roads in present day Burt Michigan - there was a grocery store there, which is now a house). On the page before this one, the last person enumerated is George W. Lawhead - apparently living in Fosters. Presumably, this means they were living near each other in 1890.

Q. Without disclosing any name I will ask if you can identify either of the pictures I show you.
A. Yes, that small picture is of my brother George Lawhead. His full name was George W. Lawhead. I have here some pictures of him and one is the same as the one you show me. It was taken in Jackson, Mich at time of his discharge from the army. He and my first husband served together in Co. B. 2nd Mich Cav. I have had four husbands, but all are dead.
No, I never knew of my said brother having any other name. No, I never heard of his being known by the name Loyd.
Q. How many times was he married?
A. Twice and only twice that I have ever heard of. His first wife was Mary King. He and she became acquainted at James Van Alstine's where he was working and I think they were married in this county. She had one boy before she married my brother but I don't know whether she was married before. Her reputation was not good. She had only one child, a boy, by my brother. She claimed to me herself that the first boy was not his.
My brother finally left her and went north somewhere and later I visited him and another wife near Chesaning. I don't know any name of that wife, but she had two girls Margaret and Effie by him. That was over thirty (30) years ago. The last I knew of him he was living on Water Street, Saginaw, Mich. That was as much as 25 years ago and I don't know whether he is living or dead. I could get no answer to my letters.
Q. Was he ever divorced from Mary King?
A. I couldn't tell you.
I have heard that Mary King is in Lansing, but I have never known anything special about her since my brother left her. No, I have never heard of her being married since my brother left her.
He left her because she was not a good woman - because she was not true to him. She has a brother "Doc" King here in Grand Ledge.
I have no interest in this pension claim.
