The soldier and the claimant Mary were ceremonially married in Eaton County, Michigan, October 16, 1865, and lived and cohabited as husband and wife for a year or two when the soldier deserted Mary. He was then married in Saginaw County, said State, January 31, 1869, to one Emma Stiles, who, according to his statement in his family data circulars, died April 8, 1886. It is alleged that he was then married to one Helen, from whom he soon separated and concerning whom nothing further was ascertained, after which, as alleged, he was married in Crawford County, Michigan, to the claimant Henrietta, mother and guardian of the minors claimed for, with whom he appears to have lived until his death, which occurred in Charlevoix County, said State, January 20, 1905. The evidence, record and parol, tends to show that neither he nor Mary ever procured a divorce. The soldier was not married prior to his marriage to Mary. Mary was previously married in Eaton County, Michigan, January 8, 1854, to one Orrin Doan, from whom she separated a few months later and who survived her marriage to the soldier and died, apparently undivorced, October 22, 1876. It is evident that if Mary's marriage to Doan was a valid marriage, she never became the lawful wife of the soldier, for she and Doan were never divorced and her relations with the soldier terminated long prior to Doan's death. But it is quite evident that Mary's marriage to Doan was not a valid marriage. Sec. 3204, Compiled Laws of Michigan, 1857, effective at the time said marriage was contracted, provides as follows: Every male who shall have attained the full age of eighteen years, and every female who shall have attained the full age of sixteen years, shall be capable in law of contracting marriage, if otherwise competent. And Sec. 3223 provides as follows: In case of a marriage solemnized when either of the parties was under the age of legal consent, if they shall separate during such non-age, and not cohabit together afterwards, the marriage shall be deemed void without any decree of divorce or other legal process. Mary alleges the marriage record shows that she was but fifteen years of age at the time she married Doan, January 8, 1854. According to a bible record in her possession, she was born September 8, 1838, which also fixes her age at fifteen at date of marriage. And it is clearly shown that she lived with Doan only until the spring following the marriage, when her parents interfered, the separation occurring prior to the time she reached the age of sixteen years. Moreover, there is a question as to Doan's legal competency. He was thirty years of age and appears to have been previously married and there is nothing to show that his prior wife was dead or divorced at the time of his marriage to Mary. Mary's legal competency at the time of her marriage to the soldier is deemed in nowise impaired by her prior marriage to Doan, which must be considered a mere nullity. And as it appears that neither she nor the soldier procured a divorce, it follows that all of the soldier's subsequent marriages were null and void, including that to the claimant Henrietta, if any, which alleged marriage in any event must be deemed null and void as Henrietta frankly admits that she had a husband by prior marriage living and undivorced at the time it was contracted. I am therefore of the opinion that the validity of the claimant Mary's marriage to the soldier should be accepted as established, together with its subsistence up to the time of the soldier's death; that his subsequent marriage, if any, to the claimant Henrietta was null and void; that Mary is in consequence entitled to recognition as his lawful widow; and that Henrietta's title as such, carrying with it the title of the minors claimed for as his legitimate issue, must fail accordingly (See cases of Lorinda M. How many times was he married? A. Twice and only twice that I have ever heard of. His first wife was Mary King. He and she became acquainted at James Van Alstine's where he was working and I think they were married in this county. She had one boy before she married my brother but I don't know whether she was married before. Her reputation was not good. She had only one child, a boy, by my brother. She claimed to me herself that the first boy was not his. My brother finally left her and went north somewhere and later I visited him and another wife near Chesaning. I don't know any name of that wife, but she had two girls Margaret and Effie by him. That was over thirty (30) years ago. The last I knew of him he was living on Water Street, Saginaw, Mich. That was as much as 25 years ago and I don't know whether he is living or dead. I could get no answer to my letters. Q. Was he ever divorced from Mary King? A. I couldn't tell you. I have heard that Mary King is in Lansing, but I have never known anything special about her since my brother left her. No, I have never heard of her being married since my brother left her. He left her because she was not a good woman - because she was not true to him. She has a brother "Doc" King here in Grand Ledge. I have no interest in this pension claim.
